Travel Trailer Awning Use — Last updated July 28, 2024

This Service Agreement ("Agreement") is made and entered into by and between New Braunfels RV Rental LLC ("Owner") and the individual renting the travel trailer ("Renter").

1Purpose

The purpose of this Agreement is to outline the terms and conditions regarding the use of the travel trailer awning provided as part of the travel trailer rental.

2Acknowledgment of Risk

Renter acknowledges that using the travel trailer awning involves certain risks, including but not limited to damage to the awning, the travel trailer, personal property, or injury to persons.

3Use of Awning

Renter agrees to use the awning responsibly and in accordance with the following guidelines:

  • The awning must not be left open unattended.
  • The awning must be retracted during windy or stormy weather.
  • The awning should be kept clean and free from any obstructions or debris.
  • The awning must not be used to support any weight or hang items that could cause damage.

4Liability for Damages

Renter assumes full responsibility and liability for any damages to the awning, the travel trailer, or any other property that occurs as a result of using the awning. This includes but is not limited to:

  • Tears, rips, or holes in the fabric.
  • Bent or broken arms or supports.
  • Damage caused by weather due to leaving the awning extended.

5Inspection and Reporting

Renter agrees to inspect the awning upon receiving the travel trailer and report any pre-existing damage to the Owner immediately. Failure to report pre-existing damage may result in the Renter being held liable for such damage.

6Repair and Replacement Costs

In the event of damage to the awning, Renter agrees to cover the cost of repair or replacement. The Owner will provide an estimate for the repair or replacement, and the Renter will be responsible for payment.

7Indemnification

Renter agrees to indemnify and hold harmless the Owner from any and all claims, damages, liabilities, and expenses (including reasonable attorney's fees) arising from or related to the use of the awning.

8Termination of Use

The Owner reserves the right to terminate the Renter's use of the awning if it is determined that the Renter is not using it responsibly or in accordance with this Agreement.

9Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the state of Texas.

10Entire Agreement

This Agreement constitutes the entire agreement between the parties regarding the use of the travel trailer awning and supersedes all prior agreements and understandings, whether written or oral.
